Xarelto Extensive Bleeding Lawsuits Increase

Xarelto is a medication which thins the blood. Xarelto has been shown to cause excessive bleeding resulting in serious injury and sometimes death. There is no way to stop the bleeding. Xarelto lawyers are filing lawsuits against the manufacturer for lack of warnings regarding their medication.

In December 2014, the U.S. Judicial Panel on Multidistrict Litigation (JPML) centralized all federal Xarelto lawsuits into one court in the Eastern District of Louisiana. At the time, about 50 product liability lawsuits were pending in the court. That number has now increased to about 400.

Not long after the Xarelto MDL was established, Philadelphia consolidated all state Xarelto lawsuits into a mass tort in the Philadelphia County Court of Common Pleas. What started as about 70 cases has now increased to about 200.

Defendants Resisted Formation of Mass Tort

Plaintiffs involved in Xarelto lawsuits claim that Johnson & Johnson subsidiary Janssen Pharmaceuticals and Bayer Healthcare Pharmaceuticals—manufacturers of the drug—should be held liable for damages associated with serious Xarelto side effects, including severe gastrointestinal bleeding and sometimes death.

The defendants initially resisted consolidating cases in Philadelphia, arguing that New Jersey would be a better location, since that’s where the company headquarters are located. They added that most plaintiffs also lived in other states, so it didn’t make sense to bring all cases to Pennsylvania.

The cases all do not involve common issues of fact, either, the defendants argued, since Xarelto is approved for multiple purposes. These include the prevention of blood clots after hip and knee replacement surgery, and the reduction of stroke risk in patients with non-valvular atrial fibrillation.

The court disagreed, stating the cases did share common issues of fact, that the defendants had strong ties to Pennsylvania, and that the Philadelphia court was an appropriate forum for the mass tort.

The companies expressed their intentions to defend against the claims brought in litigation, maintaining that Xarelto has a favorable benefit-risk profile.

Drug Makers Failed to Warn About Serious Xarelto Side Effects

The FDA approved Xarelto in 2011. Manufacturers immediately marketed it as a more convenient option to warfarin, the leading anti-coagulant for decades, because it came in a once-daily dose and required no dietary restrictions.

Within just a year, however, reports of excessive bleeding began coming in, numbering more than 1,000 by June 30, 2012—at least 65 of those involving the death of the patient. By the end of that year, more than 151 people had died in events related to Xarelto.

Plaintiffs filed lawsuits to recover damages, claiming that the drug makers had failed to provide proper warnings on the labels. Patients were left in the dark, for instance, on the fact that there was no readily available antidote to Xarelto bleeding. While all blood thinners carry some risk of bleeding, patients taking warfarin can have that bleeding stopped with vitamin K injections. There is no such solution for patients on Xarelto, making bleeding events much more serious and potentially deadly.

State and Federal Courts to Coordinate Pre-Trial Proceedings

Both parties plan to coordinate the mass tort with the Xarelto MDL. In a recent case management conference, for instance, held in April 2015, the MDL court noted that five days before each future status conference, the defendants are to identify and share any Xarelto lawsuits pending in state courts, to facilitate coordination.

Chicago, IL: In the 12 years since the US Food and Drug Administration (FDA) first approved Yasmin birth control, could the agency have imagined that by the start of 2013 there would be no fewer than 9,455 lawsuits alleging harm from Yasmin and its close contraceptive cousin, Yaz? The US Judicial Panel on Multi-District Litigation (MDL 2100, US District Court, Southern District of Illinois), released that figure on January 14, according to PRWeb Newswire (2/6/13).

Yasmin Lawsuits Span the GlobeIndustry watchers and health advocates surmise that we haven’t seen the last of Yaz lawsuits or similar litigation involving Yasmin. The most recent Yasmin lawsuit was filed with US District Court, Southern District of Illinois (case # 3:2012cv11630) on behalf of five plaintiffs alleging serious Yasmin adverse events and Yaz side effects stemming from the use of the two controversial contraceptives.

Three of the plaintiffs allege Yasmin DVT (Deep Vein Thrombosis), together with Yasmin blood clots and heart blockages. Another plaintiff represents the estate of a woman who died after suffering a stroke. According to PRWeb Newswire, the victim had been using the Yasmin pill for a little over a month when she died.

Still another plaintiff alleges Yasmin gallbladder problems.

And concern with regard to Yasmin and Yaz continues to reverberate around the globe. In the wake of France recommending to the European Medicines Agency that Yasmin/Yaz be established as the birth control choice of last resort, the largest health insurer in Switzerland has revealed it is supporting a young Swiss woman in her legal claim against pharmaceutical giant Bayer.

According to Swiss media reports, the young woman suffered a pulmonary embolism just a few weeks after first prescribed the Yasmin pill. The embolism, it is reported, left the woman severely disabled. Medical costs related to the alleged Yasmin side effects have climbed to 600,000 Swiss francs, or $648,600 when converted into US currency value.


CSS, a health insurance powerhouse in Switzerland, wants that money back. Thus, CSS is reportedly backing the young woman in her Yasmin lawsuit, and is participating as co-plaintiff.

Metro Boston (1/9/13) reports that Bayer has agreed to pay a combined sum of $750 million to settle 3,490 US claims related to Yasmin blood clots and similar injuries involving Yaz. Another 3,800 cases pending in the US also allege blood clot injuries. However, it should be noted that those claims and Bayer’s agreement to settle cover only blood clots and Yasmin DVT. They do not include other injuries allegedly associated with Yasmin or Yaz, including Yasmin gallbladder problems.

French authorities are also seeking a restriction on the use of Bayer contraceptive Ocella, due in part to concerns over Ocella side effects.

GranuFlo news Updates, Dialysis Medication Lawsuits Consolidation

GranuFlo and Naturalyte heart attack form dialysis medication lawyers are filing lawsuits for cardiac injury and death from GranuFlo and Naturalyte.

There was a class 1 recall of GranuFlo last year due to cardiac injury during or just after dialysis treatment. NaturaLyte is a liquid acid concentrate and GranuFlo is a dry acid concentrate. Both products contain sodium acetate that converts to bicarbonate at higher then expected rates leading to immediate cardiac arrest in many dialysis patients and cardiac injury bin others.
At year s end in 2012,a Motion to Consolidate the cases into multidistrict litigation (MDL) for all federal lawsuit was filed. A request has been filed with the U.S. Judicial Panel on Multidistrict Litigation asking that all Naturalyte and GranuFlo lawsuits filed in U.S. District Courts throughout the country be consolidated for pretrial proceedings in the District of Massachusetts.
Early in 2013, Fresenius said in court papers that it agreed that consolidation of the NaturaLyte and Granuflo litigation was appropriate and supported the transfer of the cases to the District of Massachusetts
On January 3, several Plaintiffs with pending lawsuits have objected to centralizing the cases in Massachusetts, indicating that the litigation should be consolidated in the southeast, because of the number of cases filed in that region. Their choices are the Southern District of Mississippi and the Northern District of Alabama have been requested. Many Florida retired seniors are dialysis patents and have been injured or killed sue to a cardiac episode from GranuFlo or Naturalyte.

Fresenius manufactures GranuFlo and NaturaLyte used in dialysis. These drugs cause alkalosis, a condition associated with an increase in cardiovascular fatalities.

The FDA received complaints describing alkali dosing errors that occurred during hemodialysis using dialysate concentrates containing acetic acid and acetate. When metabolized, these potential sources of alkali can contribute to elevated bicarbonate levels in patients undergoing hemodialysis.

This can contribute to metabolic alkalosis, which is a significant risk factor associated with :

Low blood pressure

Cardiopulmonary arrest

Cardiac arrhythmia

Sudden heart attack

Stroke

Hemodialysis cardiopulmonary arrest

A study which was conducted between January and December of 2010 found that patients with pre-dialysis bicarbonate levels greater than 28mEq/L were 4.7 times more likely to suffer a cardiac arrest. The study also discovered that patients with pre-dialysis potassium lower than 4 mEq/L had a 6.3 times higher risk of cardiac arrest.

In May 2012 the FDA notified health care providers to consider the presence and quantity of acetate, citrate, and/or acetic acid in dialysate concentrates when determining the patients’ dialysate prescription.
